azuLine BRINGS YOU BACK TO IBIZA

1. Organization

The organization of the contest is promoted by TOJUACA IBIZA S.A with CIF A07711948 and registered office at Av. Ignacio Wallis no. 21 4th, 07800 Ibiza, from now on and indistinctly the ORGANIZER.

2. Conditions

The requirements to participate will be those described in the material destined to the promotion of the “azuLine BRINGS YOU BACK TO IBIZA” contest, and will include the necessary information in relation to the duration, method of participation, and cost of the participation.

The ORGANIZER reserves the right to make any modifications or amendments to the Terms and Conditions of the contest, as long as these changes don’t harm the competition and its participants. Modifications should be made within the validity of the contest and shall be published and informed in the same platform used to promote the contest.

3. Agreement

By joining the competition, the participants agree and accept the general terms and conditions of the contest established by the ORGANIZER.  The ORGANIZER reserves the right to disqualify participants who do not comply with them and / or who go against these rules.

4. Requirements

No purchase is necessary to join the contest. All participants must be over 25 years of age, in addition to the requirement listed below:

• Be a real person with a real profile
• Must have a B1 driver’s license for at least 3 years
• Follow @azulinehotels on Instagram
• Follow @classrentacaribiza on Instagram
• Tag in the comments the person they want to bring with them to Ibiza
• Both participants must hold a valid passport or id.
• Do not use this promotion to: disseminate political or religious ideas; promote insults or slander against third parties; use violent, obscene or offensive language; and / or publish content different from the object of the mechanics of the promotion.
• Accept in full and without reservation the present bases of participation. These legal bases claim that the competition between the different participants is done with equal opportunities and with strict respect for the rules of good faith. For this reason, any abusive or fraudulent use of these bases will result in the consequent disqualification of the participant. In the case of detecting irregularities in the behavior of the participants, the ORGANIZER will be forced to eliminate the participant. The ORGANIZER also reserves the right to eliminate all those participants that are false or of dubious origin based on the standards of Instagram profiles. In case of irregularities after the acceptance of the prize, the ORGANIZER reserves the right to exercise all legal actions against the offenders. In any case, participants who do not comply with the participation requirements set forth in these rules will be disqualified.

All azuLineHotels employees are excluded.

5. Commencement and termination of the contest

The competition’s duration will be announced through the promotional material of the contest.

6. Instagram and Facebook not associated with the contest

By accepting these Terms and Conditions, participants disassociate Instagram and Facebook from any claim they may pose during the development of the promotion, and accept that Instagram and Facebook is solely a platform totally independent of the promotion with the sole purpose of being used as a tool of promotion of the contest.

Instagram and Facebook are not in any way linked to or associated with this promotion. The information that the participants provide is given to the ORGANIZER and not to Instagram and / or Facebook. The information of the participants will only be used for the assumptions foreseen in these Bases.

7. Draw

The draw will be made through Instagram, therefore it is essential that the participants have a profile in such platform, as well as follow @azulinehotels and @Classrentacaribiza.

The mechanism of participation in the contest will be as follows: @azulinehotels will publish an image on their profile communicating the draw, where users who want to participate must name the person they want to bring with them to Ibiza in the comments. Facebook will be used as a promoting platform only and users will be invited to be redirected to azuLine’s profile on Instagram @azulinehotels in order to join the contest. Only one participation per user will be admitted.

8. Winner

After the automatic draw, the ORGANIZER will check that the selected winner meets all the requirements established in these Terms and Conditions in order to confirm the prize. The ORGANIZER will announce the winner both on Instagram and Facebook. The selected winner will be given a maximum period of 24 hours to respond and confirm the acceptance of the prize.

• Conformity and express acceptance of the prize or waiver equally express to it (conditioned or limited acceptances will not be valid). In the case of resignation, it will not be necessary to send the data and documents indicated in the following points: – Legal and valid Identification Document. If the chosen one renounces the prize, does not answer, or does not fulfill the initial requirements to be declared the winner, the ORGANIZER will communicate with the first substitute or in his case the successive substitutes up to a maximum of three (3) for the purposes of proposing the award and (if you do not waive or omit answer in turn) verify compliance with the requirements and follow the steps for the declaration of winner that have been indicated. Once the maximum number of substitutes has been reached, since everyone has resigned or does not meet the requirements established in these Rules, the ORGANIZER may declare the draw void.
• Once it has been verified that all the requirements set out in the Bases are met, the ORGANIZER will also communicate by message and / or by email the winning winner’s statement to the graceful user. The ORGANIZER will publish the final winner of the draw through its Instagram page.
• It is considered as NO acceptance of the prize and, therefore, waives the same: • If at the time of making the prize cash it was verified that the data provided by the participant turned out to be false or did not correspond with his real data. • If at any time a breach of the participation requirements contained in these Terms and Conditions is discovered. • If at any time it is discovered that the winner has incurred in any of the causes of disqualification included in these Terms and Conditions. • If the prize is not accepted within the indicated periods.
• The waiver of the prize will not give compensation or compensation right.

9. Prize

The raffle will include three nights accommodation for two people in any hotel of azuLinehotels in all-inclusive, in addition to car rental sponsored by CLASS RENTAL CAR S.L.

The ORGANIZER hold the right to decide where the accommodation will take place, being in any of the azuLine hotels in Ibiza, regardless of the area and location. The prize must be used in the dates announced in the contest.

The car will be delivered to the hotel for a duration of three days and will include insurance with unlimited franchise and mileage. The prize does not include airfare tickets or any other transportation method in and from Ibiza.

The prize will be paid according to the following conditions:

1. The prize will not be subject to change, alteration or compensation at the request of the winner.
2. The name of the winner may be published on the different digital platforms of the ORGANIZER, such as their website, Instagram page or Facebook, in accordance with the clause on data protection and transfer of image rights of these Terms and Conditions. The acceptance mechanism of the draw will communicate individually to the winner once it is officially declared.Contact and claims

11. Treatment of personal data

TOJUACA IBIZA S.A. in accordance with what is established in the regulations in force regarding the Protection of Personal Data, informs that the data will be incorporated into the treatment system owned by TOJUACA IBIZA S.A. with CIF A07711948 and registered office at AVDA. IGNACIO WALLIS, 21, 3º 07800, IBIZA (ILLES BALEARS), in order to facilitate, expedite and fulfill the commitments established between both parties, and related to participation and celebration of the contest.

In compliance with current regulations, TOJUACA IBIZA S.A. informs that the data will be kept for the period strictly necessary to comply with the aforementioned precepts.

With the present clause TOJUACA IBIZA S.A. and CLASS RENTAL CAR S.L. are informed that the data will be communicated if necessary to: banks and savings banks, public administrations and all those entities with which communication is necessary, in order to comply with the provision of the aforementioned service. Failure to provide the data to the aforementioned entities will imply that the participation in the contest cannot continue.

While not otherwise communicated, it will be understood that the data have not been modified, both entities agree to notify any variation granting their consent to use them for the aforementioned purposes.

For its part, the TOJUACA IBIZA S.A and CLASS RENTAL CAR S.L. they inform that they will proceed to treat the data in a lawful, loyal, transparent, adequate, pertinent, limited, accurate and updated manner. That is why TOJUACA IBIZA S.A and CLASS RENTAL CAR S.L., undertake to adopt all reasonable measures so that these are suppressed or rectified without delay when they are inaccurate.

In accordance with the rights conferred by the current regulations on data protection, you can exercise the rights of access, rectification, limitation of treatment, deletion, portability and opposition to the processing of your personal data as well as the consent given for the treatment of the same, directing your request to the postal address indicated above or to the email juridico@azulinehotels.com.

Likewise, it may be directed to the competent Control Authority to present the claim it deems appropriate.

12. Law

Promotional actions are governed by Spanish law.

The ORGANIZER, and the participants in the promotion, expressly waiving any other jurisdiction, submit themselves to the courts and tribunals of Ibiza for any dispute that may arise from this contest.
